Welcome to the website of H Company ("HCO," "we," "our," or "us") at www.hcompany.ca (the "Site"). These Terms and Conditions govern your use of the Site, the HCO Connect portal, and any associated services provided by HCO. By accessing or using the Site, you agree to comply with these Terms. If you do not agree with these Terms, you must not use this Site or any related services. Your continued use of the Site constitutes your acceptance of these Terms.
HCO reserves the right to update or modify these Terms without prior notice. Any updates will reflect the most current version of the Terms, and the date of the latest update will be indicated above. It is your responsibility to periodically review these Terms to remain informed about any changes. If you do not agree to the modified Terms, you must discontinue use of the Site immediately.
Eligibility and Compliance. By using this Site, you confirm that you meet the necessary criteria to access the services offered. You must be at least 18 years old or the legal age of majority in your jurisdiction. In addition, you must represent a legitimate business entity or organization, and you affirm that you have the authority to bind the entity to these Terms. Accurate and complete information must be provided during the registration process, and it is your responsibility to ensure this information remains current throughout your relationship with HCO.
Compliance with applicable local, provincial, state, national, and international laws and regulations is mandatory when using this Site. HCO retains the right to refuse service, suspend accounts, or cancel transactions if it determines that any user is in violation of these Terms or any applicable laws. Misuse of the Site or providing false information may also result in legal action.
HCO Connect Portal. The HCO Connect portal is an exclusive platform available only to businesses with approved accounts. This portal enables users to view vehicle listings, access global stock options, request quotes, and manage transactions. Additionally, the portal facilitates the upload, review, and management of documents related to vehicle purchases, streamlining the buying and exporting process.
To gain access to the HCO Connect portal, users must complete the registration process by submitting accurate company documentation. Approval for access is at HCO’s sole discretion, and all submitted information is subject to internal evaluation. Pricing on the portal is subject to change without notice and reflects deposit amounts only. Any additional fees, taxes, or shipping costs will be determined at the time of purchase.
Suppliers interested in listing vehicles or products on the HCO Connect portal must undergo a separate application process. Access for suppliers is also contingent on HCO’s approval and adherence to the Terms outlined herein.
Payment Terms. HCO provides a variety of payment options to accommodate different transaction needs. Credit card payments are accepted for deposits only and must pass 3D Secure verification. The name on the credit card must match the name of the purchasing company. Wire transfers are accepted for both deposits and balances, but all payments must originate from the registered company account. Bank transfers are available for Canadian banks only and are subject to standard clearing periods.
Certified cheques and bank drafts can be submitted in person at designated HCO locations, currently limited to Toronto and Vancouver. These forms of payment are subject to a 7-business-day hold period before funds are considered cleared. An administration fee of $250 applies to every transaction, and credit card payments are subject to a 5% processing fee charged by the payment processor.
Deposits secure vehicle availability but are refundable only under specific conditions outlined by HCO policies. The remaining balances must be fully paid before vehicles are released for shipment. Customers are required to submit payment confirmations to their account executive to finalize transactions.
Inventory and Availability. HCO strives to provide accurate and up-to-date information on available stock. However, inventory details are subject to change without prior notice. Listings include vehicle specifications, pricing (deposit-only), and location information. For security reasons, VIN numbers are not displayed publicly and will only be shared after a deposit has been received.
Customers can request detailed quotes for specific vehicles through the HCO Connect portal. These quotes will include comprehensive information about pricing, fees, and logistics. Once a deposit has been paid, an account executive will guide the customer through the final stages of the transaction, including arranging shipping and providing necessary documentation.
User Responsibilities. Users are expected to maintain the confidentiality of their login credentials and prevent unauthorized access to their accounts. Any suspicious activity or unauthorized access must be reported to HCO immediately. Misuse of the Site or portal, including the provision of false or misleading information, is strictly prohibited and may result in account suspension or legal action.
Prohibited activities include, but are not limited to, attempting to access restricted areas without authorization, engaging in fraudulent activities, or violating applicable laws. HCO reserves the right to take appropriate action against users who engage in such activities, including termination of accounts and legal recourse.
Privacy Policy. HCO is committed to protecting your privacy and handling your personal and business information responsibly. For details on how your information is collected, used, and safeguarded, please review our Privacy Policy at www.hcompany.ca/privacy-policy. The Privacy Policy forms an integral part of these Terms.
Intellectual Property. All content, trademarks, designs, and proprietary technologies on the Site are the exclusive property of HCO or its licensors. Unauthorized use, reproduction, or distribution of this material is prohibited. By submitting content to the Site, you grant HCO a non-exclusive, royalty-free license to use, modify, and display the content for business purposes.
Limitation of Liability. HCO provides the Site and services on an "as-is" basis and does not guarantee uninterrupted access or error-free functionality. While HCO strives to ensure accuracy, it disclaims liability for any errors or omissions. Users assume all risks associated with the use of the Site.
To the fullest extent permitted by law, HCO disclaims liability for damages arising from the use of the Site, including indirect or consequential damages. This limitation applies to all claims, whether based on contract, tort, or other legal theories.
Amendments to Terms. HCO reserves the right to modify these Terms at its discretion. Updates will be posted on the Site, and it is the user’s responsibility to review them periodically. Continued use of the Site constitutes acceptance of the modified Terms.
Governing Law and Dispute Resolution. These Terms are governed by the laws of the Province of Ontario and the laws of Canada. Any disputes arising under these Terms shall be resolved exclusively in the courts of Toronto, Ontario. By using this Site, you consent to this jurisdiction.
